Unconstitutional to have Cougar Closed at Night

 Amendment I

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

 

That is,

Congress shall make no law... abridging... the right of the people peaceably to assemble.

 

 

Therefore, it is my opinion that 36 CFR 261.58(L) is unconstitutional. The people’s right to assemble in public places such as Terwilliger Hot Springs in the Willamette National Forest may not be prohibited at night.)
